The Labour Relations Act provides for the self-regulation of Industries through the medium of Bargaining Councils. MIBCO is a Bargaining Council as envisaged in the Act whose mission is to create and maintain industrial peace and stability in the Motor Industry. Provision of Social Benefits for the upliftment of all persons falling within the Industry, i.e. Pension, Provident, Medical, Sick, Accident, Maternity and Holiday Pay Funds. It consists of representatives from both Employers’ and Employees’ Organisations and has equal representation from both groups. As Bargaining Councils are not funded by the State, all Employers and their Employees pay a levy for the funding of the Council. Full details of MIBCO’s Structure, Agreements, Benefits and Services will be found in this Guide. Educate employers and employees of registered establishments about the provisions of MIBCO Collective Agreements, Pension Funds, Medical Aid and other benefit funds. Investigation of complaints as they arise and compile reports to the Council. Guide employers and employees through the dispute processes of the Labour Relations Act so they comply with substantive and procedural fairness in an attempt to reduce conflicts and disputes in the Motor Industry. The MIBCO of today has transformed significantly since its establishment in MIBCO has been accredited by the CCMA to resolve most types of labour disputes which occur in our industry and its dispute resolution procedures closely mirror those of the CCMA. o Con/Arb incorporates a second process, Arbitration, at which the presiding Commissioner will listen to evidence from both parties and issue a final and binding award. If the dispute was enrolled for Conciliation only and remains unresolved, the Applicant must formally request the DRC to arbitrate. This can be done by serving a copy of the Request for Arbitration Form on the other party and the DRC.
